Acceptance of these Terms
These Terms of Service (the “Terms”) form a binding agreement between you and PayWatan. By creating an account, joining our waitlist, or using any part of the PayWatan service, you confirm that you have read, understood, and agreed to be bound by these Terms together with our Privacy Policy and our Refund Policy.
If you do not agree to these Terms, you must not use the service. If you are using PayWatan on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
About PayWatan
PayWatan is a digital mobile top-up service that lets Afghans living abroad send airtime and data packages to mobile numbers in Afghanistan, instantly and worldwide.
The service is operated by PayWatan, a company with establishments in France and Denmark. References to “PayWatan,” “we,” “us,” or “our” in these Terms mean PayWatan and any affiliated entity that provides the service in your country. Contact details are provided in Section 19.
Definitions
For clarity, the following terms have the meanings below:
- Service — the PayWatan website, mobile applications, and any related features that allow you to purchase and send mobile top-ups.
- Top-up — a digital airtime, data, or bundle credit purchased through PayWatan and delivered to a mobile number on a supported operator in Afghanistan.
- Operator — a mobile network in Afghanistan whose top-ups can be purchased through PayWatan, including Roshan, AWCC, MTN, Salaam, and Etisalat.
- Recipient — the holder of the mobile number you specify when ordering a top-up.
- Account — the user profile you create to access the service.
Eligibility
To use PayWatan, you must:
- be at least 18 years old, or the age of majority where you reside;
- have the legal capacity to enter into a binding contract;
- not be located in, or a resident of, any country subject to comprehensive international sanctions; and
- not be listed on any sanctions or restricted-party list maintained by the European Union, the United Nations, the United States, or another competent authority.
We may refuse, suspend, or terminate service to any person who does not meet these requirements.
Your account
You may need to create an account to use parts of the service. When you do, you agree to provide accurate, current, and complete information, and to keep that information up to date.
You are responsible for safeguarding your account credentials and for any activity that takes place under your account. Notify us immediately at hello@paywatan.com if you suspect any unauthorized access. We may suspend or close accounts that show signs of fraud, abuse, or compromise.
You may close your account at any time by contacting us. Closing your account does not relieve you of obligations incurred before closure.
The PayWatan service
PayWatan lets you purchase a top-up and have it delivered to a Recipient’s mobile number on a supported Operator in Afghanistan. When you place an order, you are instructing us to arrange the delivery of that top-up on your behalf.
The service is intended for the convenience of individual users sending top-ups to family, friends, and other personal contacts. PayWatan is not a money transfer service, a remittance service, a bank, or a payment institution. We do not transmit funds to the Recipient — we deliver a digital airtime, data, or bundle credit procured from the relevant Operator.
Pricing and fees
Prices for top-ups are displayed in the service before you confirm your order. The total amount you pay includes the value of the top-up, any applicable PayWatan service fee, and any taxes required by law. We do not charge hidden fees.
Exchange rates, where shown, are quoted at the moment you place the order and may change between sessions. Prices may also vary by Operator, package, and country of purchase. We reserve the right to change prices at any time, but changes will not affect orders already placed.
Your payment provider, bank, or card issuer may apply additional fees, foreign-exchange charges, or holds that are outside of our control.
Delivery and confirmation
Top-ups are delivered electronically by the relevant Operator and are typically credited to the Recipient’s mobile number within seconds of a successful order. Delivery times depend on the Operator’s systems and may occasionally be delayed.
You are responsible for entering the correct Recipient mobile number and selecting the correct Operator and package. Once a top-up has been delivered to the number you provided, the transaction is complete and the credit cannot be recalled.
We will send you a confirmation when delivery is successful. If you do not receive confirmation within a reasonable time, contact us so we can investigate.
Refunds and reversals
Because top-ups are delivered instantly and consumed by the Recipient’s mobile account, they are generally not refundable once successfully delivered.
We will, however, refund or credit your order if:
- your payment was charged but no top-up was delivered;
- you were charged more than the amount confirmed at checkout due to a system error on our side; or
- the wrong package was delivered as a result of our error.
Refund timelines and the full process are described in our Refund Policy. We are not required to refund top-ups delivered to a number you entered incorrectly, to top-ups consumed by the Recipient, or to losses caused by Operator outages outside our reasonable control.
Prohibited use
You agree not to use PayWatan to:
- violate any applicable law, regulation, or third-party right;
- facilitate fraud, money laundering, terrorism financing, or any other criminal activity;
- purchase top-ups for resale or for any commercial redistribution scheme without our prior written consent;
- use stolen, unauthorized, or otherwise illegitimate payment instruments;
- interfere with, probe, or attempt to reverse-engineer the service or its underlying infrastructure;
- harvest data from the service or use it to build a competing product; or
- harass, threaten, or defraud other users, our staff, or our partners.
We may suspend, restrict, or terminate your access to the service if we reasonably believe you have engaged in any of the above.
AML, sanctions, and compliance
PayWatan operates from the European Union and complies with applicable anti-money-laundering, counter-terrorism-financing, and international sanctions rules. We may, from time to time, ask you to verify your identity, the source of your funds, or the purpose of a transaction, and we may decline or unwind a transaction if we cannot complete that verification to our satisfaction.
We monitor activity on the service and may report suspicious transactions to the competent authorities where required by law, including without notice to you where notice is prohibited.
Intellectual property
The PayWatan name, logo, website, applications, software, design, text, graphics, and all other content are owned by PayWatan or our licensors and are protected by intellectual property laws.
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the service for its intended purpose, subject to these Terms. You may not copy, modify, distribute, sell, or create derivative works of any part of the service without our prior written consent. Operator names and logos are the property of their respective owners.
Third-party services
PayWatan relies on third parties to provide elements of the service, including Operators, payment processors, identity verification providers, and infrastructure suppliers. We are not responsible for the acts or omissions of these third parties, and their own terms and privacy practices may apply to your use of their services.
Where the service links to a third-party site, app, or product, we provide the link for convenience only and do not endorse the third party or its content.
Service changes and availability
We work to keep PayWatan available 24/7, but we cannot guarantee uninterrupted service. The service may be unavailable from time to time for maintenance, upgrades, regulatory reasons, or events outside our control.
We may add, change, suspend, or discontinue features, Operators, packages, or countries supported by the service at any time. We will, where reasonable, give you advance notice of material changes that affect features you actively use.
Disclaimers and limitation of liability
The service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, PayWatan disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms limits any right you may have as a consumer that cannot be waived by contract under applicable law.
To the maximum extent permitted by law, PayWatan, its directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of the service. Our aggregate liability for any claim arising from or related to a transaction is limited to the amount you paid for that transaction.
Indemnification
You agree to defend, indemnify, and hold harmless PayWatan, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your misuse of the service, your violation of any law, or your infringement of any third-party right.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page and, for material changes, notify you through the service or by email before the changes take effect.
Your continued use of the service after the changes take effect means you accept the updated Terms. If you do not agree with the changes, you must stop using the service and may close your account.
Governing law and contact
These Terms and any dispute arising out of or in connection with them or the service are governed by the laws of France, without regard to its conflict-of-laws rules. The competent courts of France will have non-exclusive jurisdiction to settle any such dispute, except where mandatory consumer-protection rules in your country of residence give you the right to bring proceedings before another court.
If you are a consumer resident in the European Union, you may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
